§ 10.36.080. Authority to remove and/or immobilize violating vehicles.

  • The police department and all members thereof assigned to traffic duty are authorized to immobilize by affixing a booting device or have removed and towed away by a commercial towing service, any car or other vehicle which on at least three separate occasions, violates or fails to comply with Section 10.36.060 by failing to pay the enumerated fines associated therewith. The cars or vehicles so towed shall be stored on city property or in a public garage or parking lot and shall be restored to the owner or operator thereof after payment of the expense incurred by the city in removing and storing such cars or vehicles. In addition to the towing charges and/or booting fee to be paid by the owner or operator, there shall be a penalty of fifty dollars for violation of this section. It shall also be deemed necessary for the owner or operator to pay all outstanding parking violation fines due and owing prior to said vehicle being restored to the owner or operator thereof or the immobilization device being removed.
